Welcome to WebbySalesPro.
By accessing or using our platform, you agree to be bound by these Terms and Conditions (“Terms”), which constitute a legally binding agreement between you (“User,” “you,” or “your”) and WebbySalesPro (“we,” “us,” or “our”).
If you do not agree to these Terms, you must not use the platform. Continued use signifies your full and unconditional acceptance.

1. Use of the Platform

WebbySalesPro grants you a non-exclusive, non-transferable, revocable license to access and use the platform solely for lawful business or personal webinar-related purposes.
You agree to:

  • Use the platform only in compliance with all applicable laws and regulations (including privacy, data protection, and anti-spam laws).
  • Not copy, modify, resell, distribute, reverse-engineer, or otherwise exploit the platform or its features.
  • Not use the platform to transmit unlawful, harmful, or misleading content, or to engage in abusive or fraudulent activity.

Violation of these Terms may result in suspension or permanent termination of your account.

2. Account Registration

To access certain features (e.g., creating webinars, hosting events, or managing offers), you must register for an account.

You agree that:

  • All information you provide is accurate, complete, and current.
  • You are solely responsible for maintaining the confidentiality of your login credentials.
  • You will promptly update your account if any information changes.

WebbySalesPro reserves the right to suspend or terminate accounts for false information, misuse, or violations of these Terms.

If your organization uses team or company accounts, you acknowledge that your access and data may be controlled by organizational administrators who can manage, add, or remove users.

3. Subscriptions and Payment

Access to certain premium features (such as advanced webinar analytics, multi-presenter sessions, or extended attendee capacity) requires a paid subscription.
You agree that:

  • Subscription fees are billed in advance (monthly or annually, as selected).
  • Payments are processed through our authorized payment provider (e.g., Stripe).
  • Except where required by law, all payments are non-refundable once access has been granted.

Failure to pay may result in suspension or termination of your access to paid features.
WebbySalesPro reserves the right to modify subscription fees or features with reasonable prior notice. Continued use after such notice constitutes your acceptance of the change.

4. Refund Policy

Due to the proprietary and digital nature of our services—such as live webinar hosting, analytics processing, and access to digital content—WebbySalesPro maintains a strict no-refund policy once services have been delivered or made accessible.

This policy ensures the protection of our platform’s integrity and the fairness of access for all users.
By subscribing, you acknowledge and agree to this no-refund policy.

5. Data Protection and Privacy

Your privacy is important to us.
Our Privacy Policy explains in detail how we collect, use, and protect your personal information. By using WebbySalesPro, you consent to our data practices as described there.

While we apply industry-standard encryption and security controls, you acknowledge that internet transmissions are never completely secure and that we cannot guarantee absolute protection against unauthorized access.

6. Intellectual Property

All content, code, designs, videos, trademarks, and other materials on the platform (collectively, “Intellectual Property”) are the exclusive property of WebbySalesPro or its licensors.

You may not:

  • Copy, modify, reproduce, or distribute any part of the platform or its content.
  • Use any WebbySalesPro trademarks, branding, or designs without written consent.

All rights not expressly granted are reserved.
Unauthorized use may result in civil or criminal liability.

7. User Content and Conduct

You retain ownership of the content you upload, stream, or share (e.g., webinar materials, chat messages, media uploads).
By uploading or transmitting such content, you grant WebbySalesPro a limited, non-exclusive license to host, process, and display the content solely for the purpose of operating and improving the service.

You are solely responsible for the legality and accuracy of your uploaded or broadcast content and agree not to:

  • Share content that violates intellectual property rights or privacy laws,
  • Distribute harmful code, spam, or abusive material, or
  • Misrepresent your identity or affiliation.

WebbySalesPro reserves the right to remove or restrict any content that violates these Terms or applicable law.

8. Third-Party Integrations

WebbySalesPro integrates with third-party services such as:

  • AWS IVS for live video streaming and chat,
  • Stripe for payment processing,
  • Google APIs for authentication or optional Gmail integrations.

Use of these services is subject to their own terms and policies.
We are not responsible for data handled by third-party services once it leaves our systems.

9. Limitation of Liability

To the fullest extent permitted by law, WebbySalesPro and its affiliates, officers, employees, or licensors shall not be liable for:

  • Any indirect, incidental, special, or consequential damages,
  • Lost profits, business interruption, or data loss,
  • Any claim exceeding the amount paid by you to WebbySalesPro in the 12 months preceding the event giving rise to liability.

Some jurisdictions do not allow certain exclusions, so parts of this limitation may not apply to you.

10. Indemnification

You agree to defend, indemnify, and hold harmless WebbySalesPro, its affiliates, and personnel from any claim, liability, or expense (including legal fees) arising from:

  • Your misuse of the platform,
  • Your breach of these Terms, or
  • Your violation of applicable laws or third-party rights.

11. Modifications to the Terms

WebbySalesPro reserves the right to modify or update these Terms at any time.
We will post the revised Terms on our website and indicate the date of the last update.
If we make material changes, we may also notify you by email or within the app.
Your continued use of the platform after the changes take effect constitutes acceptance of the new Terms.

12. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Florida, USA, without regard to conflict of law principles.

Any dispute arising from or relating to these Terms shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.

  • Arbitration shall be held in Miami, Florida.
  • The language of arbitration shall be English.
  • The prevailing party is entitled to reasonable attorneys’ fees and costs.

You agree to waive any right to participate in class actions or class arbitrations.

13. Termination

WebbySalesPro may suspend or terminate your access immediately if:

  • You violate these Terms,
  • You misuse the platform, or
  • You fail to pay applicable fees.

Upon termination, your license to use the platform ends, but any rights and obligations that by nature should survive (e.g., payment obligations, intellectual property rights, limitation of liability) will remain in effect.
